MOBILE MESSAGE (SMS) TERMS & CONDITIONS

NorthStar Asset Management, Inc. (“NorthStar,” “we”, or “us”) operates a mobile messaging program (the “Program”) subject to these Mobile Messaging Terms and Conditions (these “Mobile Messaging Terms”). The Program and our collection and use of your personal information is also subject to our SMS Privacy and Data Protection Policy. By enrolling, signing up, proactively contacting us via text or otherwise agreeing to participate in the Program, you accept and agree to these Mobile Messaging Terms and our SMS Privacy and Data Protection Policy.
Program Description
NorthStar does not use SMS for marketing purposes or promotional purposes. SMS is used only for as-needed, real time communications with clients, prospective clients or third parties (consultants, vendors, etc.). The nature of these communications is informational and operational in nature and not meant to replace regular email or phone communication.
We may send messages to: (1) respond to your inquiries sent to us via text messaging; (2) remind you of upcoming meeting details or changes; (3) real-time texts to answer and ask questions about your account with us; and (4) ensure you have seen key customer service emails that require your prompt attention.
Mobile messages will be sent directly from a NorthStar staff member. We never send automated messages. You agree that we may send you messages regarding the foregoing topics or any topic and that such messages and/or calls may be made or placed using a NorthStar phone number. Any information obtained in We never sell or give your SMS information to third parties.
Frequency
Message frequency will vary depending on the conversation.
Carriers are not liable for delayed or undelivered messages. The Program is offered on an “as-is” basis and may not be available in all areas, at all times, or on all mobile providers. You agree that neither we nor our service providers will be liable for any failed, delayed, or misdirected delivery of any mobile message or information sent through the Program.
Cost
We do not charge for mobile messages sent through the Program but you are responsible for any message and data rates imposed by your mobile provider. Message and data rates may apply and the wireless provider may charge you for each text message you send and receive. If you have any questions about your text plan or data plan, it is best to contact your wireless provider. Please note we may not be able to deliver messages to all mobile carriers.
How to Opt-in
Clients opt-in to receive text messages when they sign our client management agreement and provide us with their mobile phone number(s). The management agreement requires that a phone number be entered and that the client check a box agreeing to receive SMS messages. The agreement states that the client may opt out of SMS by texting STOP to any message. Upon our first contact, we ask our clients if they want to keep receiving text messages from us. Clients are directed to our privacy policy (https://northstarasset.com/nsam-sms-privacy-policy/) and SMS Terms & Conditions, which state that no phone number or consent is shared with third parties (https://northstarasset.com/nsam-sms-terms-conditions/). Also, clients can speak to their investment advisor or our client service team if they have questions or would like to opt out at any time.
Prospective clients & third parties: Recipients message us first after getting our number from our website located at https://northstarasset.com/ or in the signature of our emails. We do not initiate SMS communications before being contacted first. Upon our first contact, we ask our clients and third parties if they want to keep receiving text messages from us. You agree that any mobile phone number you provide to us is a valid mobile phone number of which you are the owner or authorized user. If you change your mobile phone number or are no longer the owner or authorized user of the mobile phone number, you agree to promptly notify us at info@northstarasset.com or clientservices@northstarasset (for clients only).
How to Opt-Out
– You may opt-out of the Program at any time. If you wish to opt-out of the Program and stop receiving mobile messages from us, or you no longer agree to these Mobile Messaging Terms, reply STOP to the mobile number the message is sent from..
– After you send the SMS message [STOP] to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us, but may continue to receive text messages for a short period while we process your request.
– Alternatively you can have your number removed from our SMS sender list by sending an email to info@northstarasset.com or calling 617.522.2635. Clients can also email clientservices@northstarasset.com.
If you want to receive SMS messages again, please either text START or send us an email communication.

Changes to Program Terms
We may modify or cancel the Program or any of its features at any time, with or without notice. To the extent permitted by applicable law, we may also modify these Mobile Messaging Terms at any time. Any such modification will take effect when it is posted to our website. You agree to review these Mobile Messaging Terms periodically to ensure that you are aware of any modifications. Your continued participation in the Program will constitute your acceptance of those modifications.
